WanSnap AI User Agreement

1.1 The "WanSnap AI" User Service Agreement (hereinafter "this Agreement") is an agreement concluded between us and you governing the rights and obligations of both parties regarding your downloading, installing, opening, registering, logging in, and using (collectively "using") WanSnap AI. Please note that other related agreements (including agreements or rules for using specific services), activity rules, announcements, instructions, and in-platform notification messages (collectively "Platform Rules") that we have published, may publish in the future, or may modify from time to time in connection with WanSnap AI are all inseparable components of this Agreement and have equal legal effect. For Platform Rules subsequently published or modified, we will notify you in an appropriate manner when providing corresponding services.

1.2 Please carefully read and fully understand this Agreement before starting to use WanSnap AI, especially clauses involving exemption or limitation of liability, clauses restricting user rights, clauses on rights authorization and information use, clauses on activating special individual services, and clauses on applicable law and dispute resolution. We have highlighted these important contents in bold to help you identify and focus on them.

1.3 If you are under 18 years of age, please carefully read and fully understand this Agreement under the guidance of your guardian, especially the terms for minors, and use WanSnap AI only after obtaining your guardian's consent.

1.4 When you use WanSnap AI, you are deemed to have read and fully understood this Agreement and agree to be bound by it as a party thereto. If you do not agree to this Agreement, you may choose not to use WanSnap AI.

1.5 Please understand that we have the right to unilaterally decide, based on the needs of WanSnap AI products, services, or operations, to entrust certain services under this Agreement to our affiliates or third parties. Please carefully read the information and relevant rules displayed on product pages when using such services. Your acceptance of those services shall be deemed as your acceptance that the rights and obligations between you and such affiliates or third parties are also governed by this Agreement and Platform Rules. We will also require such affiliates or third parties to protect your legitimate rights and interests in accordance with applicable laws.

1.6 If you have any questions, opinions, or suggestions regarding this Agreement, you may contact us through the "Contact Us" page on the WanSnap AI client or official website.

2.1 In WanSnap AI, we provide you with AI content generation and other services based on artificial intelligence ("AI") model technology; in addition, we provide various services including information publishing, interactive communication, and search queries.

2.2 You may access WanSnap AI products and services by visiting the official WanSnap AI website or downloading and installing the WanSnap AI client from app stores authorized by us. We may also pre-install the WanSnap AI client on terminal devices you purchase through cooperation with device manufacturers. If you do not obtain WanSnap AI products or services through the above legitimate channels, we cannot guarantee that the version is an official version or that it can function normally. If you suffer losses due to using an unofficial version of WanSnap AI, unless otherwise expressly provided by law, we shall not bear any compensation liability.

2.3 You need to prepare relevant terminal devices such as computers and mobile phones to use WanSnap AI. To access all functions of WanSnap AI, you need to connect your device to the internet, and you shall bear the internet and data traffic fees required.

2.4 We develop different application versions for different terminal devices. Please obtain, download, and install the official version of WanSnap AI appropriate for your device.

2.5 We grant you a personal, revocable, non-transferable, and non-exclusive right to legally use WanSnap AI. All other rights not expressly granted under this Agreement remain with us. Unless expressly authorized in writing by us in advance, you may not use WanSnap AI in any unauthorized manner, including but not limited to adaptation, reproduction, transmission, crawling, vertical search, mirroring, or trading.

2.6 To improve user experience or based on operational, security, or compliance needs, we may periodically update or change WanSnap AI products or services, including modifying, upgrading, suspending, or terminating related services. You may choose whether to update at your own discretion. If you choose not to update, some functions of WanSnap AI may be restricted or unavailable. If you do not wish to use the updated WanSnap AI, you may uninstall it yourself.

3.1 When you register or log in to WanSnap AI using a third-party account, you authorize us to obtain your information on the third-party platform (public information such as avatar and nickname, as well as other information you authorize) to generate a WanSnap AI account linked to that third-party account, enabling you to directly register, log in, and use WanSnap AI and related services. In some cases, we may need to re-verify and bind your mobile phone number to confirm the authenticity of the third-party account.

Based on our cooperation with telecommunications operators, when you use the "One-click Binding" feature, with your consent, we will use the phone number in your device as the mobile number for your WanSnap AI account, without requiring a password or dynamic verification code. If you do not wish to use "One-click Binding," you may complete the binding through other means.

3.2 You may use WanSnap AI without registering or logging in, but you will not be able to access all features. Before using certain features and/or specific services, such as AI content generation, information publishing, interactive communication, etc., you need to register or log in and complete real identity authentication in accordance with relevant national laws and regulations.

3.3 You have the right to set your WanSnap AI nickname, avatar, personal biography, and other account information. Without the express written permission of others, you may not open a WanSnap AI account in another person's name, and may not impersonate or imitate another person's name, title, trade name, trademark, or avatar. During use of the account, you may not mislead the public into confusing the account owner with organizations or individuals generally known to the public, and may not damage others' portrait rights, property rights, or other legitimate rights and interests in any form. We have the right to review your account information and may take measures including warnings, requiring corrections, resetting account information, restricting account functions, suspending use, closing accounts, or prohibiting re-registration where submissions do not comply with applicable rules.

3.4 Your WanSnap AI account is for your personal use only. It is prohibited to give, lend, rent, transfer, sell, or otherwise permit others to use the account in any form. If we have reasonable grounds to believe that the user is not the account registrant, we have the right to suspend or terminate providing services to that account.

3.5 When registering and using a WanSnap AI account, you shall provide true, accurate, legal, and valid identity verification materials and necessary information. When your registration information changes, you shall promptly update it. If the information you submit is inaccurate, untrue, or illegal, we have the right to require you to correct or supplement it, or refuse to provide related services. You understand and agree that for security and identity verification reasons, you may not be able to modify the initial registration information and other verification information.

3.6 You shall maintain the security and confidentiality of your WanSnap AI account and bear legal responsibility for all actions under it. If you lose your account, you may follow our appeal process to apply for account recovery. We only verify whether the information provided in the appeal is consistent with system records, and cannot verify whether the appellant is the true owner of the account. If your account is stolen due to your improper storage or other personal reasons, the corresponding losses shall be borne by you. If you discover unauthorized use of your account or any security vulnerabilities, please notify us immediately.

3.7 According to relevant laws and regulations, if you have not logged in to and used your account for more than six consecutive months after registration, we have the right to freeze or reclaim your account. If your account is reclaimed, the information and usage records saved under the account cannot be recovered. We will notify you before taking such action, and will proceed if you fail to respond as prompted.

4.1 You acknowledge and commit that in the process of using WanSnap AI: you shall respect privacy and ethics and protect data security, and shall not input or share any unauthorized personal information, confidential information (including but not limited to trade secrets), or other unauthorized information; you shall respect others' legitimate rights and interests, ensure your input content is legal and compliant and created by you or legally authorized, and shall not infringe on others' copyrights, patent rights, trademark rights, portrait rights, name rights, voice rights, reputation rights, honor rights, or other rights. You shall not use WanSnap AI for illegal activities such as impersonating others, and shall not use technologies such as deep learning, virtual reality, or generative AI to generate, produce, publish, or spread rumors, false information, or other illegal content.

4.2 When you generate, produce, publish, or spread non-real information or content that may cause public confusion or misidentification using AI technologies (hereinafter "AI Content"), we have the right to add appropriate labels in accordance with applicable laws and mandatory national standards; at the same time, do not obstruct, obscure, modify, or delete the labels we add to AI Content in any way. If you fail to add explicit labels to AI Content as required by law, resulting in public confusion, the consequences and responsibilities shall be borne by you.

4.3 We are committed to providing a civilized, rational, friendly, and high-quality communication platform. After completing real identity authentication, you may use WanSnap AI to generate, produce, and publish images, text, and other information content. When you generate, publish, or spread information related to current affairs, public policies, or social events, you shall accurately indicate the source of information.

4.4 You shall not input, generate, produce, reproduce, publish, or spread the following illegal or non-compliant content:

• Content that opposes the basic principles established by the Constitution;
• Content that endangers national security, leaks state secrets, subverts state power, or undermines national unity;
• Content that damages national honor and interests;
• Content that distorts, vilifies, desecrates, or denies the deeds and spirit of heroes and martyrs, or infringes on their names, portraits, reputations, or honors;
• Content that promotes terrorism or extremism, or incites terrorist or extremist activities;
• Content that promotes ethnic hatred or ethnic discrimination, or undermines ethnic solidarity;
• Content that undermines national religious policies or promotes cults and feudal superstition;
• Content that fabricates or spreads rumors or false information, disrupts economic or social order, or undermines social stability;
• Content that disseminates obscenity, pornography, gambling, violence, murder, terror, or incites crimes;
• Content that insults or defames others, infringing on their reputation rights, privacy rights, portrait rights, intellectual property rights, or other legitimate rights and interests;
• Commercial advertisements that violate internet advertising laws and regulations;
• Other content prohibited by laws and administrative regulations.

4.5 You shall not input, generate, produce, reproduce, publish, or spread the following inappropriate content, and shall actively resist the spread of such content:

• Using exaggerated titles where the content seriously does not match the title;
• Hyping scandals, misconduct, or other negative content;
• Improperly commenting on natural disasters, major accidents, or other disasters;
• Content with sexual implications or provocation that easily causes sexual associations;
• Content displaying blood, horror, cruelty, or other scenes causing physical or mental discomfort;
• Content that incites population discrimination, regional discrimination, etc.;
• Content promoting vulgar, mediocre, or sycophantic material;
• Content that may cause minors to imitate unsafe behaviors or behaviors violating social ethics, or induce unhealthy habits in minors;
• Content that intimidates or threatens others, or engages in cyberbullying;
• Content that spreads obscene language and damages social public order and good customs;
• Other content violating laws, regulations, public policies, or public order and good customs, or that may interfere with our normal operations or infringe on others' legitimate rights and interests.

4.6 You shall not input, generate, produce, reproduce, publish, or spread content that is deceptive, highly dangerous, or harmful to the physical or mental health of performers or others:

• Any deceptive content such as fraud, deceit, or misleading information;
• Any content involving violence and/or self-harm;
• Any content that threatens life and health, uses dangerous implements, or where the performance method may endanger the personal and/or property safety of oneself or others;
• Content that encourages or induces others to participate in dangerous activities that may cause personal injury or death.

4.7 You shall not input, generate, produce, reproduce, publish, or spread information that disrupts the platform's business order, including but not limited to spam, commercial solicitation, excessive marketing information, information unrelated to the content being commented on, or information using character combinations to evade technical review.

4.8 If we have reasonable grounds to believe that your actions violate or may violate the above agreements, we have the right to take action, including but not limited to warning reminders, restricting account functions, suspending or terminating all or part of WanSnap AI services without prior notice, and pursuing legal liability in accordance with the law.

5.1 Paid Service Description
Some WanSnap AI services are provided for free, but some functions require VIP activation. The specific rights and benefits, usage rules, billing methods, charging standards, and payment methods for VIP membership or paid cards are subject to the details on the relevant APP pages. WanSnap AI may modify charging rules and standards based on actual needs. Before any such modifications or commencement of charging, WanSnap AI will make notifications or announcements on the relevant service pages. If you do not agree with the changes, you should stop using the service.

5.2 Service Activation, Benefits, Service Period, and Charging Standards

(1) To activate paid services, you shall ensure throughout the process that you possess full civil rights capacity and full civil capacity for conduct, and have the actual capacity to sign and fulfill the rights and obligations under this Agreement. If you do not have civil capacity commensurate with your actions, you shall obtain informed consent from your guardian. In particular, if you are a minor, please read and determine whether to agree to this Agreement under the guidance and supervision of your guardian.

(2) You may complete the purchase of this service through various existing and future payment channels or methods designated by this App to become a VIP member or enjoy consumable paid credits. When you confirm and successfully pay the membership service fee and complete all required procedures, and after approval by this App, you may enjoy the service.

(3) WanSnap AI reserves the right to adjust quotas and usage rules based on business needs, and changes will be notified to users through service page announcements or notifications. If users do not agree with the adjusted content, they should stop using the related services.

6.1 You shall not use any plugins, cheats, systems, or third-party tools to interfere with, damage, modify, or otherwise affect the normal operation of WanSnap AI, including but not limited to using any automated programs, software, or similar tools to access WanSnap AI, collect or process its information or content.

6.2 You shall not engage in any behavior that endangers the security of WanSnap AI systems, nor use WanSnap AI to engage in any behavior that endangers computer network security. Such behaviors include but are not limited to:

• Illegally intruding into networks, interfering with normal network functions, stealing network data, and other activities endangering network security;
• Providing programs or tools specifically used for intruding into networks, interfering with normal network functions, or stealing network data;
• Knowing that others are engaged in activities endangering network security, and providing technical support, advertising promotion, payment settlement, or other assistance;
• Using unauthorized data or accessing unauthorized servers or accounts;
• Accessing public computer networks or others' computer systems without permission and deleting, modifying, or adding stored information;
• Without permission, attempting to detect, scan, or test weaknesses in WanSnap AI systems or networks;
• Attempting to interfere with or disrupt the normal operation of WanSnap AI systems or websites, or deliberately spreading malicious programs or viruses;
• Forging TCP/IP data packet names or partial names;
• Reverse engineering, reverse assembling, or compiling WanSnap AI, or otherwise attempting to discover its source code;
• Maliciously registering WanSnap AI accounts, including but not limited to frequently or in bulk registering accounts;
• Other behaviors that may endanger the computer network security of WanSnap AI or other platforms.

6.3 Without our written permission, no users or third parties may, on their own or by assisting others, perform the following acts on information or content in WanSnap AI:

• Using WanSnap AI information or content to promote their own products, gain users for their own products, or confuse the relationship between their products and WanSnap AI, for purposes of unfair competition;
• Arbitrarily editing, organizing, or adapting WanSnap AI information or content and displaying it on channels or platforms other than WanSnap AI's source pages;
• Using technical means to modify, hijack, divert traffic from, cover, insert, or pop up WanSnap AI information or content, preventing users from normally using WanSnap AI;
• Stealing, monitoring, copying, spreading, displaying, mirroring, uploading, downloading, or using WanSnap AI information or content through improper means such as hotlinking, crawling, simulated downloading, deep linking, or fraudulent registration;
• Using, spreading WanSnap AI information or content by hiding or modifying WanSnap AI domain names, logos, or user information;
• Using WanSnap AI information or content obtained without authorization for statistical analysis of hot keywords, hit rates, classifications, search volumes, click rates, reading volumes, or usage volumes;
• Using WanSnap AI information or content for any form of sales and commercial use beyond our written authorization, or providing it to or allowing third parties to use it in any form;
• Interfering with data related to WanSnap AI information or content, including affecting content usage, playback volumes, or tampering with WanSnap AI data;
• Using WanSnap AI products, services, information, or content to develop, provide, or operate products, models, or services that compete with WanSnap AI;
• Other behaviors of illegally obtaining or using WanSnap AI information or content.

6.4 If we have reasonable grounds to believe that your actions violate or may violate the above agreements, or your other actions cause WanSnap AI's information and content to be adversely affected, or cause WanSnap AI users' rights and interests to be damaged, we have the right to take action, including terminating services to you without prior notice, and pursuing legal liability of relevant parties in accordance with the law.

7.1 If you violate this Agreement including Platform Rules, we have the right to take measures depending on the circumstances, including advance warning, refusing to generate or publish content, immediately stopping information transmission, deleting content, short-term prohibition of publishing content or comments, restricting some or all account functions, up to terminating service provision, permanently closing accounts, prohibiting re-registration, and other measures prescribed by laws and regulations. Adverse consequences such as WanSnap AI functions becoming unavailable, account information deletion, content deletion, or inability to obtain account assets or other rights and interests shall be borne by you. We have the right to not restore deleted user information or content.

7.2 We have the right to announce the handling results, and have the right to decide whether to restore the use of relevant accounts based on actual circumstances. For behaviors suspected of violating laws and crimes, we will preserve relevant records and have the right to report to relevant competent authorities in accordance with the law and cooperate with their investigations.

7.3 We respect and protect the intellectual property rights, reputation rights, name rights, privacy rights, portrait rights, voice rights, and other legitimate rights and interests of users and others. If you infringe on the legitimate rights and interests of any third party, causing third parties to file complaints, reports, or seek compensation through litigation or other means, we have the right to take necessary measures as required by law. If your actions cause us to bear compensation liability to any third party, suffer punishment from national authorities, or incur other economic or reputational losses, you shall compensate us for all losses suffered as a result.

8.1 All intellectual property rights in WanSnap AI products and services belong to us, including but not limited to software, technology, programs, web pages, text, images, audio, video, charts, layout design, and electronic documents, except for rights that relevant rights holders should enjoy according to law. The copyrights, patent rights, and other intellectual property rights of the software on which we rely to provide WanSnap AI products and services all belong to us, or we have obtained valid authorization.

8.2 During your use of WanSnap AI, you may submit text, images, and other content to WanSnap AI (collectively "Input Content"), and WanSnap AI generates images, text, and other content in response (collectively "Generated Content"). You understand and commit that the Input Content and content you publish when using WanSnap AI are all originally created by you or legally authorized, and do not contain any content that violates laws and regulations, infringes on others' legitimate rights and interests (including intellectual property rights and other rights such as personality rights and personal information rights), or violates public order and good customs. Within the scope permitted by law, the intellectual property rights and other property rights arising from Input Content, Generated Content, and information content you publish using WanSnap AI belong to you or the rights holders entitled to such rights.

8.3 To continuously improve the services WanSnap AI provides to you, you understand and agree that for the Input Content, Generated Content, and information content you publish using WanSnap AI, you grant us a worldwide, royalty-free, non-exclusive, multi-level sub-licensable right to use them to provide services to you under this Agreement, optimize our products, services, and models, and ensure the security and stability of services. If you do not wish us to use them for the aforementioned purposes, you may contact us through the feedback page.

8.4 To enable your works to be better shared and promoted, for information content you publish through WanSnap AI, you grant us a worldwide, royalty-free, non-exclusive, multi-level sub-licensable right, including the right of modification, reproduction, translation, compilation, information network dissemination, adaptation, and the right to create derivative works, perform, and display. The scope of use includes WanSnap AI or other websites, applications, or smart terminal device products. You agree that we have the right, on our own or by authorizing third parties, to use such content in any publicity, promotion, advertising, marketing, and/or research related to the above content or us. The above rights and licenses include the right to use, reproduce, and display personal images, portraits, names, trademarks, service marks, brands, names, logos, and corporate marks (if any) embedded in the content, as well as any other brand, marketing, or promotional assets.

8.5 To better protect your rights, you confirm that we have the right, based on the above authorization, to enforce rights independently or entrust third parties to enforce rights for the content you upload and publish. Rights enforcement forms include but are not limited to: monitoring infringing behaviors, sending rights enforcement letters, filing lawsuits or arbitration, mediation, and settlement. We have the right to make decisions on rights enforcement matters and implement them independently.

8.6 Based on the characteristics of certain features, content you upload and publish on WanSnap AI may be used by other users when creating and publishing related content using WanSnap AI. Other users may also create new generated content based on your content through features such as "Same Style," "Use as Inspiration/Reference Image," and other AI content generation functions (subject to the actual display names on product feature pages), and publish, forward, copy, or download them.

8.7 We provide technical support for the development and operation of WanSnap AI and enjoy all rights within the scope permitted by law for all data and information generated in the process of WanSnap AI development and operation.

8.8 Please do not under any circumstances use, remove, or tamper with any trademarks, service marks, trade names, domain names, website names, or other brand identifiers related to the WanSnap AI brand (collectively "Identifiers") without our prior written consent. Without our prior written consent, you shall not display, use, or apply to register trademarks or domain names using the aforementioned Identifiers alone or in combination, nor perform any act indicating to others that you have the right to handle such Identifiers. If you cause losses to us or others due to using, removing, or tampering with Identifiers in violation of this Agreement, you shall bear all legal responsibilities.

9.1 The conclusion and performance of this Agreement (including its entry into force, fulfillment, interpretation, amendment and supplementation, termination, and dispute resolution) shall be governed by the laws of the mainland of the People's Republic of China; if there are no relevant legal provisions, commercial practices and/or industry practices shall apply by reference.

9.2 If any clause of this Agreement is terminated or deemed terminated, invalid, or unenforceable, that clause shall be deemed a severable clause and shall not affect the validity and enforceability of the remaining clauses.

9.3 Unless WanSnap AI makes a written statement, no action taken by WanSnap AI under any circumstances shall be interpreted as a waiver of rights.
